Terms & Conditions

The following terms and conditions apply to all accounts opened by the customer (referred to as ‘you’) with T.H.E Film Academy Limited (referred to as ‘T.H.E Film Academy’, ‘us’ or ‘we’ or ‘our’); at T.H.E Film Academy’s website, mobile application, email application, message application or any other interface (referred to as T.H.E Film Academy) that contains a link to this Terms and Conditions.

By using T.H.E Film Academy and/or opening an account with T.H.E Film Academy, you agree to be bound by the terms and conditions (referred to as the ‘Terms’) set out herein. Please make sure you have read and understood the Terms before opening your account.

The terms might be amended from time to time without prior notice to you. However, the version of the Terms that will apply to your account will be those on T.H.E Film Academy at the time you open your account until you accept the new Terms.

Age Limit For Users

Only persons of legal age, 18years, or older depending on your place of residency can open an account. A Guardian can open an account on behalf of his/her minor/child and the user would be the Guardian for the purposes of the transaction.

Our Liabilities

T.H.E Film Academy accepts liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

T.H.E Film Academy is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the services or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident, general unrest, pandemic and terrorist activity.

Severance

In the event that any one or more of the provisions of the Terms is held for any reason to be invalid, illegal or unenforceable in any respect, by a court of competent jurisdiction, arbitrator, regulator or by operation of law, such invalidity, illegality or unenforceability shall be omitted and shall not affect any other provision of the Terms, and the Terms shall be construed as if such invalid, illegal or unenforceable provision was not a part of the Terms.

Ownership of rights

All intellectual property rights, such as trademarks and copyrights at T.H.E Film Academy remain that of T.H.E Film Academy Limited, its subsidiaries, assignees or licensors. Any use of T.H.E Film Academy or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of T.H.E Film Academy.

Violation of Our Terms

T.H.E Film Academy wants to provide the best possible experience to you. To make this possible we need to ensure that our services runs like a clockwork.

You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying T.H.E Film Academy, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

Dispute Resolution

You shall use your best endeavour to settle any dispute or difference between you and T.H.E Film Academy arising using a service on T.H.E Film Academy.

If the dispute, difference or claim is not resolved amicably within one month after initiating the first attempt at such amicable settlement, the dispute, difference or claim shall be submitted to the Lagos Multi-Door Courthouse (LMDC) for mediation, which mediation shall be conducted in accordance with the LMDC Mediation Procedure Rules in force at the time.

Each party shall bear its own costs and would be liable to contribute equally in respect of fees to be paid to the Mediator (if any)

Applicable law

The Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
